Microsoft sues DHL after train dumps 21,600 Xboxes

In a complaint filed in the U.S. District Court for the Western District of Washington in Seattle, Microsoft said it is seeking more than US$2 million in damages from DHL for two containers of Xbox consoles that sustained "impact damage, wetting, pilfering and shortage" after a derailment near Duke, Texas.

The Xboxes were en route from a Microsoft office in McAllen, Texas, to Long Beach, California, for eventual delivery to Hong Kong at the time of the loss, which occurred on Oct. 13, 2007, according to court papers. Flextronics Industrial in Hong Kong was the intended recipient.

Microsoft claims that DHL has refused to compensate it for the loss, even though the delivery service "negligently breached its duties as a common carrier, handler, bailee, warehouseman, agent, or in other capabilities," according to the court papers.

DHL could not be reached for comment Friday.

Wait, that means that they are only asking for about $90 per xbox. DHL should be biting Microsofts hands off!

A Mercedes-Benz seen near the tracks was said to have fled the scene shortly after the incident took place.
One eye-witness reported noticing a very distinct PS emblem on the left side of the passenger seat door, as well as the abbreviation "SCEE" on the shirt of the driver.
The driver has yet to be identified...

Yeah i heard about this one....21,600...WOW. that's a LOT of lost merchandise.

Can't blame Microsoft for suing. Their hands are pretty much tied there.

sometimes the shipping companies mishandle them not suprised thats why i was scared to death getting from repair and having a dead box. somethings cant be helped like a tractortrailer getting into accident on blackice or whatever mother nature throws at it. but when people show them literaly throwing fragile stuff like a quarter back is another story. they left my uncle package on the outside of his house luckily there mostly good people in the neighborhood who didnt steal it. when he got home in the afternoon he wasnt so happy though.

Those poor, poor 360's. Lost. Waiting for someone to love them. Just to press their joysticks. Here we see this unfortunate 360 starving. This is Jon, he has two brothers and his parents were killed in the train accident. He can't support what's left of his family alone. So, for less than the cost of a postage stamp, you can make sure that Jon never goes hungry again.
