yah I am, and thanks to everyone for all the help, but i already sent it in to apple and they already sent me a new one.

Something similar happened to me, try letting it die completely then connect it to iTunes. While we're on the topic, iHATE iTUNES

Apple are good like that. Rang up their customer services the other day fir help and they fixed the problem within mnutes and didn't just tell me to turn it off then turn it on again.

Try letting the battery burn out. Then once it's completely dead, plug it into your computer's USB port.
